Public Notice- Code of Conduct

At the Council meeting of 11 February 2016, the following resolution was passed unanimously in relation to a code of conduct matter concerning a Councillor:

That Council, pursuant to clause 8.5(b) of the Procedures, make the following findings of inappropriate conduct by Councillor Claudia Gall public via Council’s website and the Council Clipboard:

That Councillor Claudia Gall has breached the Moree Plains Shire Council Code of Conduct clause 3.1e) by intimidating council employees and civilian workers in a manner that was likely to bring the council or holders of civic office into disrepute.

That Councillor Claudia Gall has breached the Moree Plains Shire Council Code of Conduct clause 6.2b) by directing and influencing a member of staff and a delegate of the Council.

That Councillor Claudia Gall has not breached the Moree Plains Shire Council Code of Conduct clause 6.7f). There is no direct evidence that Councillor Gall made detrimental comments about the actions of council and contract staff to members of the public.

That Councillor Claudia Gall be formally censured for the breach under section 440G of the Local Government Act 1993 for bringing Council into disrepute by intimidating council employees and civilian workers, directing council employees and contractors, endangering council employees, contractors and herself by entering the exclusion zone as per security camera footage.

That Councillor Claudia Gall provide an unconditional written apology, through the General Manager, to council employees and contractors addressing all the breaches listed in point 1 of this resolution within seven days.

That the matter be referred to the Office of Local Government for further action under the misconduct provisions of the Local Government Act 1993.
